Surrogate Parents
When a child is referred for special education services--or already has an active IEP--the local education agency (LEA) must ensure that a surrogate parent is appointed under the following circumstances:
- The child's parent(s) are unknown.
- The parent(s) cannot be located after reasonable efforts.
- The child is a ward of the State and their educational rights have been removed by a court.
